I don't think you have to have a subscription to rhn, but if you do have a 
subscription (entitlement in RH lingo) then you get priority over non-entitled 
users for updates. Non-entitled systems can't typically get through to the 
up2date servers during times of peak usage.
I recently purchased an entitlement, but had been using up2date with good 
success for the last year or so without one.
As for having to be root, as far as I know, that is required in order to 
update the rpm database and install system binaries. I usually just run 
up2date using sudo.
